SFCCC, our partner clinics, and patients have been eagerly awaiting the opportunities that would be provided by President Obama’s executive actions to allow many immigrants to apply for work authorization and protection from deportation. Unfortunately, The U.S. Court of Appeals for the Fifth Circuit recently denied the U.S. Dept. of Justice’s request for an emergency stay in Texas, et al. v. United States, et al., the lawsuit against these actions. This will allow a lower court’s decision to block implementation of the initiatives while the Justice Department’s formal appeal of the lower court’s decision is considered. The legal issues are far from over and immigration advocates expect President Obama to ultimately prevail, but unfortunately this initial outcome delays (possibly until summer, 2016) implementation of measures that would provide safety, work opportunities, and (in California) health coverage for many immigrants.
